These Terms govern the relationship between the user (from now on, “the customer”) and MEMBA, located at Rua Padre Raposo, 909, Mooca – São Paulo/SP, CEP 03118-001, CNPJ 13.278.553/0001-52, hereinafter MEMBA.

Using this website and its services implies full acceptance of the provisions in this notice, in the version published by MEMBA at the time the user accesses the website.

Description of the service

The purpose of the website is to offer a contact service between customers who need a given product and the suppliers in our accredited network who offer that product.

MEMBA offers customers a digital quoting platform so that requests made by customers are forwarded in full to our accredited supplier network. MEMBA will not interfere in any case in the negotiations between Customers and Suppliers in our accredited network, remaining always unrelated to them.

MEMBA will not at any time assume responsibility for work performed by a Supplier in our accredited network for a Customer, nor for the Customer’s obligations to the Supplier, expressly declining any dispute that may arise between them.

Use of the services

Customers undertake to use the services offered through the website in accordance with applicable law, these Terms of Use, the particular conditions for certain services and other notices and instructions brought to their attention, as well as generally accepted morals and good customs.

The Customer will refrain from using any material and information on this website for unlawful purposes and/or purposes expressly prohibited in these Terms of Use and in the particular conditions that may apply in certain cases; that are contrary to the rights and interests of MEMBA, its members and/or third parties, and will be liable to them in the event of non-compliance; and/or that in any way damage, disable, overload, deteriorate or prevent the normal use of the materials and information on the website, the information systems or the documents, files and any content stored on any computer equipment of MEMBA, its members or any User of the website.

The Customer undertakes that information provided about their company or themselves is true.

The Customer undertakes to refrain from:

Acquiring contact data in order to send advertising of any kind for sale or other commercial activity;
Making available to third parties data acquired on membalagens.com.br;
Charging any amount or compensation related to the use of information provided by the customer using our website.

Price and payment

MEMBA provides a free service acting as a digital quoting platform in order to connect interests through the internet.

Cookies

MEMBA may use cookies generated by the Customer when browsing its web pages. Cookies that may be used are associated exclusively with the browser of a specific computer (that is, the Customer is anonymous) and do not provide any personal data of the Customer. Cookies serve internal purposes only, such as website access statistics. The cookies used cannot read cookie files created by other providers or websites. The Customer can configure their browser to be notified of cookie receipt and to prevent cookies from being installed on their hard drive.

MEMBA informs that it is subscribed to “Google AdSense” advertising systems that use cookies to show advertising related to the type of browsing performed by the Customer.

Google AdSense: when a Customer accesses a web page that is indirectly subscribed to the “Google AdSense” service and clicks on that page, a cookie is automatically placed in their browser, through which Google collects the Customer’s browsing information in order to administer and then send ads through the “Google AdSense” advertising program. The customer may cancel use of the Google cookie at any time by disabling the cookie in their browser.

Exclusion of warranties and liability

Except in the cases expressly described in the General Conditions of Use and the rest of the website’s regulatory framework, MEMBA is not liable for damages of any kind that may arise from lack of accuracy, completeness or currency, or from errors or omissions that the information and services on this website or other content accessible through it may suffer, nor does it assume any duty or commitment to verify or monitor its content and information.

The exclusion of warranties and liability for the operation of membalagens.com.br and its services does not guarantee the availability and continuity of the operation of membalagens.com.br and its services. MEMBA will try to give sufficient prior notice of interruptions that may occur in the operation of membalagens.com.br and its services, whenever this is possible.

Exclusion of warranties and liability for improper use by MEMBA’s Customers of the services and content of membalagens.com.br, in disagreement with these Terms of Use and, in certain cases, with the Particular Conditions that may apply. MEMBA also does not guarantee the truth of data that Suppliers in our accredited network provide about themselves, whether in their registration or in their participation on the site. Likewise, MEMBA does not guarantee that content placed on the website by Customers or Suppliers in our accredited network respects these general conditions, the particular conditions, and applicable law.
